About These Terms And Conditions

In these Terms and Conditions "we" and "us" mean Bit Mb Pty Limited ABN 63 120 968 and "you" means you the customer. "Product" means any goods purchased on bitoo.com.au

These Terms and Conditions together with your Order constitute the entire Contract between us and you for the supply of Products. The Contract cannot be varied unless we agree to vary it in writing or by email. 

 

Australian Sales Only

We sell and ship Products only within Australia. We will not make deliveries outside of Australia.

 

Legal Capacity To Transact

If you are under the age eighteen (18) years you cannot place orders us. By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years. 

 

Placing Your Order

You may place an Order by filling in the Order Form on the Bitoo Web Site and clicking the "Submit My Order" button. 

When you place your Order, we will issue you with an Order Number. We will do this by email. 

 

By placing an Order, you make an offer to us to purchase the Products you have selected based on these Terms and Conditions. We will notify you that your order is being processed by sending you an Order Confirmation and tax invoice via email; however, we do not formally accept your offer until your order has passed our internal validation procedures for verifying the bona fides of each order placed, for the purpose of preventing credit card or payment fraud. Bit Mb reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion. We will confirm acceptance of your order when we send you an email confirming shipment of the goods you have ordered. If we cannot process or accept your Order after payment is received we will contact you by email or telephone. 

 

Payment Methods And Processing

Bitoo currently accepts PayPal, Bank Transfers, Bank Deposits, Money Orders, Personal or Business Cheques,  Visa, MasterCard and ANZ Go Money. 

Payment processing will not begin until we receive all the information we need. Orders placed on a weekend or a Public holiday will not begin payment processing until the next business day. 

Business days are Monday through Friday, excluding VIC Public holidays. 

We process credit card and PayPal payments after you click the "Submit My Order" button. 

Your tax invoice is your proof of purchase. 

 

Please Note:

We are unable to accept credit cards issued by banks outside of Australia.

You may be required to provide further identification for additional security reference checks.

 

GST

All fees and charges identified in these terms and conditions and all prices for the products purchased on the Bitoo website include GST, where applicable.

 

Shipping Costs

Bitoocurrently offers free delivery anywhere in Australia.All products are shipped by Au Post registered eParcel system or by Couriers. All deliveries must be signed for and will not be left in the mail box are at the door.Unless otherwise agreed by us, we will deliver your Products to the address indicated on your Order Confirmation. If no-one is available to take delivery of your Products, our carrier (Australia Post eParcel) will leave a card so you can pick-up your Product from your local Post Office. Where delivery is by our courier service and no-one is available to take delivery, they will leave a card requesting you to telephone them to arrange a suitable time and date for delivery. 

 

Insurance is not included in the free shipping offer – for your piece of mind we strongly suggest to get the insurance option at check-out.

Title and risk of loss to all Products will pass to you on delivery

 

Supply Of Your Products

Subject to these Terms and Conditions, we will supply to you the Products indicated on your Order Confirmation. 

When your Order items have been dispatched, we will email you to confirm shipment of each item including a tracking number for each item. 

 

Delivery Of Your Products

Delivery time takes up to 10 working days from the date your payment is received.Bitoo makes every effort to deliver your Product according to the estimated delivery times. The estimated delivery times are in business days (Monday through Friday) excluding Public holidays. 

Although every effort is made to ship your Order according to the estimated delivery times provided, estimated ship times may change due to changes in supply or circumstances beyond our control. If your Product has not arrived after the estimated delivery time, please contact us here. 

We encourage you to visit the "Your Account" section on our website to view the delivery status of your Products. 

We will use our reasonable efforts to deliver your Products to you within the estimated delivery time indicated on your Order Confirmation; however, we do not guarantee that we will deliver within this time frame. 

 

Consumer Guarantees

Consumer guarantees apply under the Australian Consumer Law. Nothing in these Terms and Conditions excludes the application of those guarantees.

If a Product has a minor defect, we will provide a repair or offer you a replacement or a refund. If a Product has a major defect, you are entitled to:

  • reject the goods and receive a refund
  • reject the goods and receive an identical replacement, or one of similar value if reasonably available 
  • keep the goods and receive compensation for the drop in value caused by the problem.
  • If you think that a Product is defective you should contact usso we can assist you. A photo may be requested to assist with the assessment of your claim. Where a Product is defective and needs to be replaced or repaired you will need to return the product to us. If a Product is replaced, your replacement Product becomes your property and the returned Product becomes our property. When a refund is given, the returned Product becomes our property.

 

Return/Refund Policy

If your product is defective on arrival or incorrectly shipped, please notify Bitoo within 4 days of receiving the product. Return the defective or wrongly shipped product to us within 14 days of notification.

You will need to provide the following information, most of which will be on your invoice before we can offer a refund or replacement:

  • Name and contact details of original purchaser 
  • Invoice number
  • Product code of product to be returned 
  • Date on invoice 
  • Date of receiving the product 
  • Reason for return 

If you return a product because it was defective on arrival but we find that the product is in full working condition or any defects or damage were caused after you took receipt of the product, it will be returned to you. You will be invoiced a processing fee and any freight costs associated with the return. These invoiced amounts will be payable within 14 days of receipt of invoice. 

If the product is defective or incorrectly shipped (different to the one you ordered), upon receipt of the returned product, we will offer you to select either a replacement product or a refund by applying a credit against the credit card used for the original purchase issued for the original purchase price of the product and associated freight cost.

A copy of the purchase invoice must be included with the returned product.

You are responsible for all costs associated with return of the product to us and we will not pay or reimburse any associated costs. We recommend that products returned by post be sent by registered or certified mail. We accept no responsibility for loss or damage occurring in transit. If a product is not returned to us in the original unopened packaging, it may be returned to you at your cost.

 

Our Liability

To the extent permitted by law:

  • We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.
  • Our maximum aggregate liability for any Product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.
  • Credit Card Fraud
  • While Bitoo employs Secure Sockets Layer (SSL) technology software for its transactions with our customers, Bitoo will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.

 

Terms of Use

  • By using our website, you agree to these Terms of Use. If you do not agree to these Terms of Use, you may not use this site. Bitoo reserves the right, at any time, to modify, alter or update these Terms of Use, and you agree to be bound by such modifications, alterations or updates.
  • Bitoo does not represent nor warrant that the information accessible via our website is accurate, complete or current. We are not responsible for typographical errors. Price and availability information is subject to change without notice.
